# FINMA approves Switzerland's first retail bitcoin ETF, waiving diversification rules
*The regulator cleared an exchange-traded fund that holds bitcoin directly and granted an exemption from risk-spreading limits.*

Switzerland's Financial Market Supervisory Authority [FINMA announced](https://www.finma.ch/news/2026/10/20261020-mm-finma-bitcoin-etf/) on October 20, 2026 that it has approved the country's first exchange-traded fund for retail investors that invests directly in bitcoin.

FINMA classified the product under Swiss fund law as an "other fund for alternative investments" with a specific risk. It granted an exemption from the applicable risk diversification rules, citing bitcoin's "long trading history and a particularly high trading volume compared with other cryptocurrencies." The regulator said other providers have submitted or announced applications for bitcoin ETFs.

The approval is the first of its kind under fund law. Crypto exchange-traded products already list on Swiss exchanges, but FINMA's guidance of January 12, 2026 treats them as structured products, meaning debt securities, under financial services law. FINMA's earlier crypto fund approval, the Crypto Market Index Fund in September 2021, was restricted to qualified investors and held mainly a basket of cryptocurrencies rather than bitcoin alone.

Under the January 12, 2026 guidance, a Swiss custodian bank should generally hold the fund's bitcoin. A third-party custodian in Switzerland or abroad is permitted only with equivalent oversight and bankruptcy protection that keeps the coins separate from the custodian's estate if it fails. The guidance names cyberattacks and inadequate protection of private keys as operational risks that supervised institutions must reduce.

Sellers must follow the conduct rules of Swiss financial services law at the point of sale, including clear warnings about volatility and the risk of loss, and a suitability check on the buyer. FINMA says this gives investors more protection than buying cryptocurrencies directly. The regulator also said the fund's documents must highlight and explain the risks, and that bitcoin investments remain highly risky because of sharp price swings.
